Our “Advocate Program” was formed to assist pet owners with any legal issues. To accomplish this, we have formed a strong network of committed animal rescue/welfare groups, legal support groups and individuals, and have been blessed with the many resources needed to help people with situations that may arise. Storms Animal Allies receives countless requests from individuals and families who want to help their animals, and are seeking our assistance.
Much of the Storms Animal Allies advocacy work in the past has been ‘behind the scenes’ rather than in public.
Much as we would like to provide direct support to each and everyone that contacts us, time and budget restraints can prevent us from doing so.
It should not be a scary feeling when we hear the words ANIMAL CONTROL, ANIMAL SERVICES, THE POUND, OSPCA, OR HUMANE SOCIETY…etc…
but for some, it is very scary.
This page is meant to provide you with information you will need if the safety and security of your furbaby is at risk.
It is important as an animal owner that you comply with Ontario’s Society for the Prevention of Cruelty to Animals Act
Ontario’s March 2009 amendments were the first significant changes to that province’s animal protection law since 1919. The amended law provides the courts with greater flexibility to impose stiffer penalties, including jail time up of to two years, fines up to $60,000, and a potential lifetime ban on animal ownership. It also allows Ontario SPCA investigators to inspect premises (other than private dwellings) where animals are kept for exhibition, entertainment, boarding, sale, or hire; and permits the Society to“APPLY“ for custody of an animal while a case is still before the courts.
The legislation now also establishes standards of care for all animals, not just dogs and cats; requires veterinarians to report suspected animal abuse or neglect with protection under the law; makes it an offence to train an animal to fight with another animal or to own animal fighting equipment; and makes it an offence to harm a law enforcement animal, such as a dog or horse.
If animal control, O.S.P.C.A. officer or Humane Society agent has informed you that they will be coming to your home to see your animal or to inspect your animal, you do not have to invite that officer in, nor do you have to hand over your animal. An Animal Control officer or OSPCA officer or Humane Society officer can not remove your animal without your permission unless they have a “Warrant“. DO NOT HAND OVER YOUR ANIMAL UNLESS THEY HAVE THE WARRANT IN HAND. and a summons to inform you of your charges. They must also inform you of your rights AND the process to appeal. If you hand over your animal it is called a “voluntary surrender”. This means that they(Animal Control, O.S.P.C.A.,Officer of Humane Society Agent, or from an organziation demanding or suggesting they take possession of your pet) will have ownership of your dog until a court decision has been made. When trying to persuade you or what you may feel is manipulation, they may tell you that they (animal control, O.S.P.C.A. officer or Humane Society agent) can impose fines of $10,000 or that you will do jail time if you do not “voluntary surrender” your animal. …NOT TRUE…that is only if a court has heard your side of the case and feel that you have broken the law. It is then the courts can impose fines and possible jail time ..but we have never heard of a case in Canada that those conditions have been imposed.
